Big News for Education Freedom Families: The EFTC Is Law — and States Are Choosing Sides
The Education Freedom Tax Credit is now federal law — but access depends on your state. Here is where things stand and how to get ready.

No. The Education Freedom Tax Credit is deliberately designed to protect the independence of private schools and homeschools — it runs on private donations, not government funding, and the law expressly prohibits federal officials from controlling the curriculum, creed, or admissions policies of participating schools.
Many parents assume that accepting a federal tax-credit scholarship means inviting the government into their child’s classroom. The fear is familiar: “federal money” always seems to arrive with “federal strings” that could one day force a Christian school to change its biblical teaching or hiring practices.
That instinct comes from decades of watching government programs extend their reach into private institutions. Families genuinely need financial relief to afford tuition — but they are rightly unwilling to trade religious liberty for a scholarship. The result is a cultural tug-of-war in which parents feel forced to choose between affordability and conviction.
The state should remain a servant to the family — never the master of the child.
We believe the sovereignty of God over education is expressed through parents. The Education Freedom Tax Credit is a tool for parental stewardship precisely because it relies on the voluntary, charitable choices of private individuals. And because administration stays in the hands of local Scholarship Granting Organizations like ours, the family — not the bureaucracy — keeps the reins.
The Educational Choice for Children Act (ECCA), which created the EFTC, contains explicit “super-protection” language for religious schools. Under the federal code, participating in the program does notmake a private school a “recipient of federal financial assistance.” That legal distinction is vital: the regulations that normally attach to federal funding simply do not apply to the schools your children attend.
